
As an LGIS member, it's vital to understand that under the Western Australian Workers Compensation and Injury Management Act (2023), having a return to work (RTW) program is a legal requirement.
The implementation of a comprehensive RTW program is a vital tool that not only supports injured workers but also benefits local governments by reducing costs and promoting positive health outcomes.
Your responsibilities:
- Develop a RTW plan promptly when:
- A medical certificate indicates partial incapacity, or
- The healthcare provider advises its need in writing.
- Ensure the plan aligns with the worker's medical restrictions and focuses on returning them to their pre-injury duties or suitable alternative roles.
- Importantly, you must involve the injured worker in the development of the RTW plan, ensuring their participation and consent. The signed RTW plan must be sent to LGIS within seven (7) days of being drafted.
- The goals should be clear, achievable, and agreed upon by all stakeholders - including the worker, employer, and healthcare professionals.
- The return to work goal will vary depending on several factors, including the individual's injury or illness, their pre-injury job, the support available from their employer and treatment team, and their overall recovery progress. Goals can range from returning to the same job with the same employer to finding a new job with a different employer, or even transitioning to a different role with the same employer.

- During audits, WorkCover WA can impose fines if no appropriate RTW program exists.
- Penalties can impact your organisation's reputation and finances.
- Lack of a plan delays recovery, increases claim costs and risks legal action.
